[Memorandum Discussing Plans on Taxation, Workplace Smoking, Environmental Smoke, and Youth Program]
Abstract
Reports ratification of Communications Committee Report by Tobacco Industry Executive Committee (TIEC) and discusses plans in three subjects headings: "I. Taxation; II. Smoking in the Workplace and Environmental Smoke; [and] III. Youth Program". Notes section I. entails "'battle plan' similar to the National Tobacco Education Council book and the various individual state taxation plans" and assigns responsibility for federal and state components of report. Notes section II. should contain credible case history research on decisionmaking processes in organizations and assess whether industry "should be willing to compromise or accommodate". Notes section III. should follow approach of "Responsible Living" document. Concludes final drafts require approval of counsel before submission to TIEC.

AS you know, the Executive Committee met on November 30th
to address the report of the Communications Committee. It
was unanimously agreed that we would proceed as follows on
the three subjects covered by the report:
I. TAXATION:
The Staff will prepare a detailed "battle
plan" similar to the National Tobacco
Education Council book and the various
individual state taxation plans. The
Staff can call on any resources needed,
including the Communications Committee
through its Chairman. The "battle plan"
is to cover two separate areas - Federal
and State.
Preparation of the Federal Section should
be the primary responsibility of Howard
Liebengood and his Federal Affairs Divi-
sion, using any resources needed.
The State Affairs Section should be the
primary responsibility of Roger Mozingo
and his State Affairs Division, using
Bill O'Flaherty, M. R. Haley and any
other resources needed.

While the E.C. doesn't intend to detail
contents, any and all actions, materials,
printed matter, proposed advertising, etc.,
should be included in both Federal and
State portions.
SMOKING IN THE WORKPLACE AND ENVIRONMENTAL SMOKE:
The E.C. sees this subject divided into
three parts and this "battle plan" book
should address each separately. They are:
i. The legislative problem
2. The private or corporate
employer-employee problem.
3. The public sector (governmental)
employer-employee problem.
The E.C. desires immediate research to develop
two case histories of how companies came to
install "Smoking" - "No Smoking" areas. Who
in the organization initiated the proposal?
Who or what department picked it up? Was
the CEO involved? Did he ultimately approve?
What "scientific" or other information was
relied on? etc., etc.
In all three of these areas, address whether
the Industry should be willing to compromise
or accommodate and, if accommodation is re-
commended, what sh-----ould that accommodation be,
recognizing that there can be no concession
or accommodation on the smoking and health
controversy.
The E.C. is very desirous of developing more
Solmon-type data, but, hopefully, from a •
reputable institution not subject to dis-
creditation.
One idea, presented for specific exploration
(from Sparber's previous work, I believe),
is the offering of an architectural engineering
consultant's help to companies or governmental
bodies or agencies.

Included in this plan book, as in the
Taxation Book, should be "when this happens,
we do this and then ........ " as well as
"before this happens, we should do ."
The E.C. doesn't want to detail this plan
and recognizes that a great deal of work
is in existence. We also realize that you
and the Staff have worked on this fore
year or more and it's not being accepted
already is due to our delay.
The E.C. believes that the most effective
approach is that taken in your previously
proposed "Responsible Living" document.
Please arrange to have prepared a draft
of a pamphlet or booklet on "Responsible
Living" and several ads to be run in the
general media we've used before. These
ads would serve to announce the availa-
bility of the pamphlet and state the
Industry position as our previous ads
have.
Since different TI Divisions will be working on these
three projects, we hope they can all commence at once and
proceed at the same time. All are important but II and III
should take precedence if something has to give. As always,
we may take forever to make up our minds, but that doesn't
prevent our wanting the job done yesterday. Seriously. the
sooner the better, but with no quality sacrifice.
[AS soon as final drafts are complete, they should first
go to Shook Hardy and C&B. Upon their approval, send to the
members of the E.C.~
