Dear Mr. Secretary:
_
On January 11, 1978 you addressed the National, Inter-
agency Councilion Smoking and Health, and in that address
you said "I am today announcing a vigorous new program on
smoking and health. backed by higher budgets. .." Also,
you stated in that address that you planned to reprogram
several million dollars of fiscal year 1978 funds.
Recently, the Subcommittee staff, at the request of
Mr. Natcher, a member of the Subcommittee, contacted
your office to inquire about the status of the reprogramming
letter. The staff was informed that the use of the word
reprogramming in your address was an error, and that a
better description of your actions to initiate a new program
on smoking and health is one of redirecting FY 1978 funds;
and thus, the Department did not intend'to forward a
formal reprogramming request to the Subcommittee. This
is not acceptable to Mr. Natcher and myself.

Let me point out,, Mr. Secretary, that it has always been?
'the policy of this Subcommittee, and in fact it is theJ,
policy_of the Appropriations Committee, that significant j,
deviations from approved budget plans must be reviewed~
and approved by the Committee.! From your speech, it
appears that you are planning to use FY 1978 funds for
purposes other than for which they were appropriated'.
For example, there was no discussion during the 1978
hearings on the budget, nor is there any mention in the
1978 President's budget message, about the establishment
of a new office of smoking and health. However, this
is one of your stated objectives for the new program.

" I do not intend, at this time, to address each and every
point of your proposed new initiative for smoking and
health; but however, it is clear to me, as Chairman ofJ
the Labor-HEW Subcommittee, that prior approval from.'
the Committee is required before HEW can spend FY'1978 ~'
funda,.to initiate a new program for smoking and health:
Accordingly, Mr. Secretary, the Subcommittee awaits your
reprogramming letter, which we would like to have at
your earliest convenience so that we may have the opportunity
to review your revised budget plans in a timely manner.
Thanking you in advance for your cooperation in this
matter.
